Commission rate exceeds FIFA cap

Critical

The agreed commission rate in this contract is above the FIFA Football Agent Regulations cap. Under the FFAR 2025, an agent may not receive more than 5% of a player's gross remuneration when representing the player's interests. Rates above this are not enforceable under FIFA rules and may expose the agent to disciplinary action.

Clause 7.2: "The Agent shall be entitled to receive a commission equivalent to 12% of the Player's gross annual salary for the duration of this agreement and any renewal thereof..."

Recommendation: Do not sign this contract without renegotiating the commission clause to bring it within the 5% FFAR cap. You are entitled to request this reduction and any licensed agent should accept it.

Perpetual image rights assignment

Critical

This clause assigns your image rights to the agent in perpetuity with no financial compensation stated and no mechanism for reclaiming them. Image rights are a significant and growing source of athlete income. Signing them away permanently without compensation is a serious financial harm.

Clause 11.1: "The Player hereby grants to the Agent an irrevocable, worldwide, perpetual licence to use the Player's name, likeness, image and biography for any commercial purpose at the Agent's sole discretion..."

Recommendation: Request that this clause be deleted entirely or replaced with a limited, time-bound licence that expires when the representation agreement ends. Any image rights usage should require your written consent and attract separate compensation.

Automatic renewal clause

Warning

The contract contains an automatic renewal provision. Unless you give written notice within a specified window, the agreement renews automatically for a further term. This window is only 30 days, and the clause is located in the final section of the document where it is easily missed.

Clause 14.3: "This agreement shall automatically renew for successive 12-month periods unless either party provides written notice of termination no less than 30 days prior to the expiry of the then-current term..."

Recommendation: Set a calendar reminder well before the 30-day notice window. Consider requesting that the automatic renewal clause be removed, or that the notice window be extended to at least 90 days.

Governing law and jurisdiction
